Sick-leave selfies can get you fired: spanish courts draw the line
A beach photo posted from a “sick” bed is fast becoming the quickest way to a Spanish dismissal letter. Judges have just tightened the screw: if your holiday snaps clash with the medical reason you’re off work, consider yourself fired.
What the gavel actually said
The Supreme Court has stacked up a dozen rulings in 2024 that turn the old “I’m on rest” excuse into a minefield. Judges no longer ask whether you are capable of working; they ask whether your behaviour delays recovery. A warehouse worker with a lumbar sprain who uploaded kite-surf footage in Tarifa? Dismissed for breach of contract. A call-centre agent signed off for anxiety yet geo-tagged a stag do in Ibiza? Same ending.
The legal hook is article 54 of the Workers’ Statute: grave breach of contractual duties. The trick is that “grave” is now defined by the medical report, not by the boss’s temper. If the doctor has ordered no long-haul flights and you land in Bangkok, the judge calls that bad faith, pure and simple.

No banned activities, only banned contradictions
There is no black list of forbidden islands or sports. Courts examine three pixels: the diagnosis, the activity, the timeline. A bus driver with a broken ankle can still go to the cinema; a software engineer with burnout can spend a week in a Finnish cabin—provided the psychiatrist OKs it in writing. The lethal mistake is to boast: every Instagram story is time-stamped evidence.
Companies are quietly feeding social-media scrapers into HR dashboards. One retail chain caught 37 offenders last year after cross-checking TikTok uploads against sick-leave dates. The payout they saved: €1.2 million in severance they no longer owed.

How to travel without losing your pay cheque
Get a signed medical clearance before you pack. Keep the trip short, low-impact and, above all, boring—if it looks restorative, courts buy it. Judges have upheld dismissals when the only proof was a tagged beach volleyball photo; they have also acquitted workers who produced WhatsApp voice notes from their doctors blessing a quiet coastal retreat.
Bottom line: the days of the wink-and-nod sick leave are gone. Spain’s labour courts have weaponised your own timeline. Stay consistent or stay home—otherwise the next notification you get won’t be a “like”, it’ll be a pink slip.
